The petitioner is languishing in custody since 19.02.2014 in a case registered for the offences punishable under Sections 328 and 302 of the Indian Penal Code. The informant being the wife of the victim has alleged that her husband went to Chambalghati on call he took tea in the company of this petitioner and Praveen when the elder sister of the husband of the informant informed the informant that she received call of this petitioner that informant's husband is in PMCH in serious conditions and when the informant reached there she found her husband dead.

Patna High Court Cr.Misc. No.1868 of 2015 (02) dt.16-01-2015 2/2 petitioner that after examining the case diary similarly situated accused Parveen @ Arsari Khatoon has been granted bail vide Cr. Misc. No. 27686 of 2014 on the ground that there is no witness to suggest that any poison was mixed in the tea when the tea was brought from the shop of Raju @ Razi Ahmad by Sargent. The tea vendor also disclosed that Sargent took four cups of tea and offered to the victim and others.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Pirbahore P.S.
