In this case, the petitioner is seeking anticipatory bail in connection with Bihiya P.S. Case No. 397 of 2018, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation has been made that 22 liter of Mahua liquor has been recovered from the house of the petitioner. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass

Patna High Court Cr.Misc. No.80 of 2019(3) dt.16-01-2019 2/2 appropriate order on the same day without being influenced by the order of this Court.
