The petitioner is languishing in custody since 28.07.2014 in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim got her age recorded as 20 years when the court has assessed as 18 years where she has stated that she of her own married with Shobhan Yadav and she has never been kidnapped.

No.1861 of 2015 (02) dt.16-01-2015 2/2 It is submitted by learned counsel for the petitioner that the petitioner is cousin of Shobhan yhadav and hence, he has been roped in the present case. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Turkaulia (Banjaria) P.S. Case No. 389 of 2014.
