In this case, the petitioner is seeking bail in connection with Dariyapur P.S. Case No. 213 of 2015 registered for offences under sections 147, 148, 149, 448, 341, 323, 307, 354 and 427 of the Indian Penal Code and later on Section 302 I.P.C. was added.
Allegation has been made that on 07/08/2015 seven persons in a planned way, entered into the house of the informant and when the mother of the informant tried to stop them, she was pushed out and the accused persons caused injury to the victims, they have brought to the Government hospital. During the investigation it was found that Upendra Narain and Indrajeet Rai
Patna High Court Cr.Misc. No.7374 of 2016 (3) dt.11-04-2016 2/2 have taken active part to assault the victim in which one person died.
The counsel for the petitioner submits that similarly situated person, namely, Tun Tun Ray has already been granted bail by this Court in Cr. Misc. No. 5201 of 2016 and except Ram Babu Rai, this Court had granted bail to the different accused persons.
Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Dariyapur P.S. Case No. 213 of 2015, subject to the condition that the petitioner would cooperate in the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
