2. The petitioner seeks bail in connection with Maheshkhunt P.S. Case No. 198 of 2023 registered for the offence under Sections 188, 420, 467, 468, 471/34 of the Indian Penal Code and under Section 30(a), 32(i)(ii), 41 of the Bihar Prohibition and Excise Amendment Act, 2022.

3. As per the prosecution case, 3438 liters of foreign liquor has been recovered from a truck and the petitioner is the driver of the said truck.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case.

5. Learned counsel for the petitioner further submits that the petitioner is in custody since 27.9.2023.

6. Learned counsel for the petitioner also submits that the petitioner, without accepting his guilt undertakes to deposit Rs. 50,000/- Ramkrishna Mission Ashrama, Nala Road, Patna.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge-II, Khagaria in connection with Maheshkhunt P.S. Case No. 198 of 2023.

9. As a condition of this order, the bail bonds of the petitioner shall be accepted by the Court below, only after he brings a receipt of Rs. 50,000/- in the name of Ramkrishna Mission Ashrama, Patna. The Court below will first verify the genuineness of the receipt and if the receipt is found to be genuine then the bail bonds of the petitioner shall be accepted. (Sandeep Kumar, J) Vikas/- U T
