JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2019 The petitioners apprehend their arrest in connection with Surajgarha P.S.Case No. 225 of 2018 registered under Sections 147, 323, 353, 354, 379 and 504 of the Indian penal Code. Allegation as per FIR is that when election of Anganbari Sevika was going on, petitioners along with other accused persons obstructed, abused and tried to snatch documents. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against them and they have falsely been implicated in this case.
Heard learned APP, who has opposed the prayer for anticipatory bail stating that petitioners no. 1 and 2 have

Having heard both sides and in the facts and circumstances, as stated above, so far as petitioner no. 3 is concerned, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, he shall be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Surajgarha P.S. Case No. 225 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. So far as petitioner nos. 1 and 2 are concerned, I am not inclined to grant privilege of anticipatory bail to them rather they should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order, if possible, on the same day.
