The appellant seeks anticipatory bail in connection with A.B.P. No. 1670 of 2018 and Araria SC/ST P.S.Case No. 46 of 2016, registered for offences punishable under Sections 341, 342, 323, 354 (A), 384, 379 and 504/34 of the Indian Penal Code and under Section 3(i) (r) of the SC/ST Act. The allegation against the appellant as per F.I.R. is that during scuffle between the parties the appellant had put his hand in the blouse of the informant and taken Rs. 3000-. Submission of the learned counsel for the petitioner is that there is scuffle between the parties and in order to give serious color, the present case has been lodged but the appellant has no criminal antecedent.

APP (SJ) No.203 of 2019(2) dt.06-02-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, this appeal is allowed and the impugned order is set aside, let the appellant, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 25,000/- ( Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge- cum- Special Judge, Araria in connection with Araria SC/ST P.S.Case No. 46 of 2016, subject to condition as laid down under Section 438 of CR.P.C.
