The petitioner is accused in connection with Nagar P.S. Case No. 311 of 2019, registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 2865.96 litres kept in different cartoons from the truck bearing registration no. UP25AT-0984, in which, three persons including the petitioner were found sitting.

Learned counsel for the petitioner submits that petitioner was neither the driver nor the Khalasi of the truck, in fact, he took the lift in the way in the truck and thereafter, at the time of checking, he was apprehended mere on suspicion. It is

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cumSpecial Judge (Excise), Samastipur, in connection with Nagar P.S. Case No. 311 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
