The petitioner seeks bail in Araria P.S. Case No. 342 of 2014 registered under section 399/402 of the Indian Penal Code and 25(1-b)a/26(II)/35 of the Arms Act.

The petitioner was apprehended by the police and from his possession one loaded country made pistol was recovered.

Learned counsel for the petitioner submits that co-accused Nazzrul @ Nazbul @ Dilawar has already been enlarged on bail vide Cr. Misc. No. 1127 of 2015. The case of the petitioner stands on the same footing. Petitioner is in jail since 23.07.2014.

Having considered the fact that petitioner has

No.3963 of 2015 (2) dt.29-01-2015 2/2 already remained in jail for more than six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of C.J.M. Araria in Araria P.S. Case No. 342 of 2014.
