In this case, there is a direct allegation against the petitioner to have caused Tangi blow on the head of the victim which led to his death.
The counsel for the petitioner submits that the victim was suffering from ailment of epilepsy and had died after three days of the occurrence, but the Post Mortem report shows the cause of death is the head on injury.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner with respect to Rajauli P.S. Case No. 228 of 2015 registered for offences under section 302/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.7290 of 2016 (3) dt.11-04-2016 2/2 The petitioner will have liberty to renew the prayer for bail after examination of the informant.
Accordingly, this petition is rejected.
