2. The petitioner has prayed for bail in connection with Nayagaon P.S. Case No. 62 of 2024 registered for the offence punishable under Sections 126(2), 115, 117, 109, 3(5) of the BNS.

3. The case of the prosecution, in short, is that petitioner has assaulted with the butt of the pistol on the head of the informant.

4. Learned counsel appearing on behalf of the petitioner has submitted that though the nature of injury is grievous but from the conduct of the petitioner it is clear that he was not having intention to kill the informant as he was having pistol, he could have fired. Learned counsel for the petitioner has further submitted that there is also counter version of this case and

5. The application for bail is opposed by learned counsel for the Informant.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai in connection with Nayagaon P.S. Case No. 62 of 2024.
