JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is allegation against the petitioner that he opened fire causing fire arm injuries to informant but it is admitted case of the prosecution that the alleged occurrence took place on account of land dispute. Moreover, the brother of the petitioner lodged counter case, i.e., Keshariya P.S. Case No.234 of 2014 for the occurrence of the same day. Petitioner is in jail custody since 16.5.2015 and it appears that the injured of the present case sustained simple injuries.
Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
Patna High Court Cr.Misc. No.7795 of 2016 (2) dt.18-02-2016 2/2 thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Keshariya P.S. Case No.234 of 2014.
