The petitioner apprehends his arrest in connection with Purnia Sadar P.S. Case No. 315 of 2019 registered under Sections 341, 323, 386, 504, 379, 427 and 506/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to land dispute. Further submission is that a proceeding under section 144 of the Cr. P.C. was also initiated between both the parties, which was closed due to pendency of the Title Suit (Annexure-2) between the parties. It is also submitted that prior to filing of the present
Patna High Court CR. MISC. No.4209 of 2020(2) dt.29-06-2020 2/2 case, Miscellaneous Application (Annexure-3) was also filed against the informant by the petitioner. Further he submits that counter case (Annexure-4) was also filed by the master of the petitioner Kafil Ahmad Quaraishi against the informant. Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bail bond to the satisfaction of the C.J.M., Purnia in connection with Purnia Sadar P.S. Case No. 315 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
