In the present case, the petitioner seeks bail in connection with Sessions Trial No. 27 of 2021 arising out of Mansi P.S. Case No. 146 of 2020 registered for the alleged offences under Sections 302, 307 and 447/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per prosecution case, petitioner along with coaccused Jhaksu Singh and two unknown miscreants came to the house of the informant and fired upon the informant but the shot missed him. Thereafter, petitioner fired upon the younger son of the informant who was taken to hospital. The son of the

Patna High Court CR. MISC. No.3793 of 2022(4) dt.06-12-2022 2/3 informant died when he reached the hospital. Meanwhile, he named the petitioner who fired upon him.

The learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. The occurrence take place in the background of some land dispute for this reason the petitioner has been falsely implicated in this case. The co-accused who ordered for the kill, namely, Jhaksu Singh has been granted bail by a Co-ordinate Bench of this Court vide order dated 06.08.2021 passed in Cr. Misc. No. 18499 of 2021. Learned counsel further submits that the petitioner is in custody since 20.06.2020 and the trial is at the stage of prosecution evidence but the same is not likely to conclude in near future.

Learned APP opposes the prayer for bail submitting that specific allegation against the petitioner that he shot dead the son of the informant. Learned APP further submits that the petitioner is a habitual offender and has got long criminal history and is having 17 cases against him.

Perused the records.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the

No.3793 of 2022(4) dt.06-12-2022 3/3 specific nature of allegation against the petitioner that he shot dead the son of the informant, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail is rejected. A report dated 10.11.2022 has been received from the learned trial court regarding the likely time to be taken for conclusion of trial and learned trial court has submitted that trial would be concluded within nine months.

However, the learned trial court is directed to expedite the process and conclude the trial within time sought by him. If the trial is not concluded within stipulated period, then the petitioner may renew his prayer for bail. (Arun Kumar Jha, J) balmukund/- U T
