JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-01-2019 The petitioner seeks bail in anticipation of his arrest in connection with Gogari P.S. Case No. 291 of 2018 dated 28.08.2018 instituted for the offences under Sections 341, 323, 447, 307, 504, 34 of the Indian Penal Code and Section 27 of the Arms Act.

For a goat of one Balmiki Pandit having strayed in the field of the informant, a fight took place in which the petitioner is alleged to have assaulted the informant. The petitioner and others are also alleged to have fired from their weapons hitting the informant in his elbow.

The learned counsel for the petitioner has submitted that earlier a complaint was lodged by the informant of the present case and a Title Suit is also pending

Patna High Court Cr.Misc. No.336 of 2019(2) dt.29-01-2019 2/2 between the parties. Apart from this, it has been stated that there is no gunshot injury of the informant which completely belies the prosecution version.

Regard being had to the aforesaid facts as also the taking into account the clean antecedents, the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No. 291 of 2018, G.R. No. 2372 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
