JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The statement of victim was recorded under section 164 of the Cr.P.C in which she stated that she was forcibly taken away by the petitioner but admitted in her statement that when petitioner got knowledge about institution of the present case, petitioner released her at Bagaha. Moreover, submission on behalf of the petitioner is that the written report of the informant, who happens to be husband of the victim, reflects that there was sweet relation between the petitioner and victim and, therefore, the aforesaid fact goes to show that the victim had eloped with the petitioner but subsequently, she took U turn under the pressure of

Patna High Court Cr.Misc. No.7603 of 2016 (2) dt.18-02-2016 2/2 her husband.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Motihari Town P.S.Case No. 593 of 2015.
