1. Heard the parties.
2. Petitioner seeks regular bail in connection with Falka P.S. Case No. 105 of 2024 dated 19.05.2024 registered under section 363, 364, 365, 506 of the I.P.C. and section 3(2)(v) of the S.C. and S.T. Act.
3. As per the prosecution case on 18.05.2024 at about 3 P.M. in the afternoon the husband of the informant had gone out of his house but did not return till night. In course of search the informant came to know that her husband had a quarrel with one Md. Munna. It is further stated that her husband had a dispute with Md. Munna who might have kidnapped her husband due to previous dispute.
4. Learned counsel for the petitioner submits that the case was initially registered under Section 363, 364, 365, 506 of the
Patna High Court CR. MISC. No.4897 of 2025(4) dt.18-04-2025 2/3 I.P.C. but in course of investigation dead body of the informant's husband was found. Later on, section 302 I.P.C. was added. He further submits that during course of investigation the police apprehended Premlal Marandi and Mahendra Marandi, who are the nephew and son of Talamai Devi and she was having illicit relationship with the husband of the informant. In the statement of Premlal Marandi the name of the petitioner has not been disclosed as would be evident from paragraph no. 23 & 25 of the case diary however in paragraph no. 71 of the case diary in the supervision note the supervising authority has added the name of the petitioner as one of the co-accused in this case. The petitioner is in custody since 29.05.2024 and charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Having considered the submissions advanced by the parties and taking into consideration the fact that petitioner is in custody for almost about one year, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, accordingly, I am inclined to grant regular bail to the petitioner.
6. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 10000 /- ( ten thousand) with
Patna High Court CR. MISC. No.4897 of 2025(4) dt.18-04-2025 3/3 two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Katihar, District - Katihar in connection with Falka P.S. Case No. 105 / 2024 subject to the condition that during the trial the petitioner shall remain present before the learned trial court on each and every date and in case of default on two consecutive dates without prior permission his bail bond shall liable to be cancelled.
