JUSTICE SHIVAJI PANDEY ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is challenging the order dated 1.7.2016 passed by the Certificate Officer, East Champaran Motihari in Certificate Case No. 24/14-15, thereby the objection raised by the petitioner has been rejected.

As per the petitioner, the Certificate Officer has not gone into the material what he has raised in his objection petition, has gone tangent and passed the order against him for deposit of Rs. 48,22,218.40. (Rupees. Forty eight lakh twenty two thousand

Patna High Court CWJC No.2180 of 2017 (2) dt.15-02-2017 two hundred eighteen and forty paise). When the petitioner failed to deposit the same, he has been put in custody and is incarcerating therein, in such circumstances, let the petitioner file a proper appeal before the Appellate Authority. In the meantime, the petitioner be released on bail to the satisfaction of the Certificate Officer, East Champaran, Motihari in connection with Certificate Case No. 24/14-15 If the petitioner files any application for interim relief, till the disposal of the same, no coercive step will be taken against him in connection with Certificate Case No. 24/14-15. Let this case order be communicated to the District Certificate Officer, East Champaran, Motihari through FAX at the cost of the petitioner.

Accordingly, this petition is disposed of.
