JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-03-2019 The petitioners apprehend their arrest in connection with Singhwara P.S.Case No. 183 of 2018 registered under Sections 363 and 366A/34 of the Indian penal Code.
Allegation as per the FIR is that daughter of the informant was kidnapped by the son of the petitioner and when he inquired about the same, he was assaulted and ousted from there. Submission of learned counsel for the petitioners is that whatever allegation is there i.e., against the son of the petitioners and petitioners are father and mother of the main accused Vimal Sah and even in her statement recorded under Section 164 Cr.P.C., girl has not made any allegation against these petitioners.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJMV, Darbhanga in connection with Singhwara P.S. Case No. 183 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
