The present application has been filed for transfer of Matrimonial (Title Suit) Case No. 43 of 2017 from the Court of Principal Judge, Family Court, Munger to the Court of Principal Judge, Family Court, Lakhisarai.

It has been submitted by learned counsel for the petitioner that the marriage between petitioner and opposite party was solemnized in the year 2016. As per opposite party the marriage was forceful after abduction but petitioner states that petitioner was abused for consistent demand of dowry and due to further more dowry the petitioner was subjected with cruelty and miscarriage was made in the clinic of Dr. Ima Siha at the instance of the opposite party. And the petitioner has been duped by the opposite arty and assaulted and abused for demand of dowry and after marriage there was consistently demand of

Patna High Court MJC No.3519 of 2018(5) dt.09-09-2022 2/2 dowry since after the marriage and ousted the petitioner from the house after committing serious offences and for which information was given to the learned CJM Munger. Learned counsel for the opposite party has been heard.

Considering the fact that the petitioner is a lady and it will be difficult for her to visit Munger on each and every date to contest the matrimonial case and that the opposite party will have no difficulty in contesting and in pursuing his matrimonial case in Lakhisarai, this application is allowed. Accordingly, Matrimonial (Title Suit) Case No. 43 of 2017 is transferred from the Court of Principal Judge, Family Court, Munger to the Court of Principal Judge, Family Court, Lakhisarai.

The records of Matrimonial (Title Suit) Case No.43 of 2017 should be immediately sent by the Principal Judge, Family Court, Aurangabad to the Principal Judge, Family Court, Madhubani.

Let a copy of this order be communicated to the Court of Principal Judge, Family Court, Munger and the Principal Judge, Family Court, Lakhisarai, through FAX for its compliance. (Sandeep Kumar, J) Guddu/- U
