For the Petitioner/s :

Mr.Umesh Chandra Verma For the Opposite Party/s :

Mr.Smt. Nirmala Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-01-2019 Heard both sides.

Petitioner apprehends his arrest in Nautan P.S. Case No.425 of 2018, registered under Sections 379 and 382 of the Indian Penal Code.

The informant alleged that three persons intercepted him while he was coming from Nautan market and snatched his mobile. On alarm, villagers came and apprehended one accused who disclosed his name as Raushan Kumar. Raushan Kumar disclosed the name of the petitioner Anil Kumar and Abhay Choudhary who managed to flee away from the place of occurrence.

Learned counsel for the petitioner submits that the petitioner owns a shop near the shop of Raushan Kumar and that is why he has got enmity with Raushan Kumar but I find

Patna High Court Cr.Misc. No.675 of 2019(2) dt.16-01-2019 2/2 nothing on record to corroborate the statements of the petitioner that he has got any enmity rather the villagers caught Raushan Kumar immediately after the occurrence and Raushan Kumar disclosed in presence of the villagers the names of two persons including the petitioner who had snatched mobile from possession of the informant.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. (Prabhat Kumar Jha, J) S.KUMAR/- U T
