Learned Counsel for the petitioner is permitted to implead the Commissioner, Tirhut Division, Muzaffarpur, as a party, Respondent No.5 to the instant writ application. The limited grievance of the petitioner is pendency of the petitioner's Service Appeal No.317 of 2019 before the newly added respondent no.5. The appeal has been preferred against the order of punishment dated 29.11.2019 passed by the District Magistrate, East Champaran, Motihari.
In view of the limited grievance, since the appeal is
Patna High Court CWJC No.987 of 2022(2) dt.02-09-2022 2/2 yet to be considered by the appellate authority and there is no objection by the State Counsel in disposal of the writ petition for passing final orders on the appeal, writ petition is disposed of with direction to the newly added respondent no.5 to consider and dispose of the appeal, if still pending by a reasoned and speaking order, in accordance with law, within eight weeks from the date of receipt/production of a copy of this order.
