The petitioner being father of the husband of the informant is languishing in custody since 25.10.2015 in a case registered for the offences punishable under sections 498A, 302/34 of the Indian Penal Code.

Prosecution case is of killing the daughter of the informant after nine years of marriage by causing burn injuries. It is submitted by learned counsel for the petitioner that accusation is omnibus and general and on conclusion of investigation final form (charge-sheet) has been submitted under section 306 of the IPC. A statement to that effect has been made in paragraph 10 of the petition, which reads as follows :- "10. That chargesheet/Chalan no.06/2016 dated

No.6701 of 2016 (2) dt.10-02-2016 2/2 20.01.2016 in connection with this case is filed under section 306 of the I.P.C. against petitioner and his elder son namely Pintu Sao @ Raushan Kumar @ Ratan Lal (husband of deceased)." It is further submitted that petitioner is aged about 73 years.

Considering the fact that investigation has already concluded and charge-sheet has been submitted under section 306 of the IPC, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur in connection with Maner P.S. Case No.454/2015.
