JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Manpur P. S. Case No. 92 of 2019 disclosing offences under Sections 379, 120B of IPC, Section 4/21 M.M. (DR) Act and Section 4/40 B.M.M.C.R. and Sections 6,4,5, (A), 5(c), 8(A) of Bihar M.P.I.M.T.S. Rules, 2003. Prosecution case is that police got an information of illegal transportation of the sand, raided the place of occurrence and found 10,000 F.T sand, which has illegally stored and petitioners who are the person who stored the sand. Submission of the learned counsel for the petitioners is that they have nothing to do with the stored sand and they have falsely been implicated in this case and considering the
Patna High Court CR. MISC. No.4481 of 2020(2) dt.23-01-2020 2/2 same, other accused person has been granted privilege of anticipatory bail by a Co-ordinaten Bench of this Court, vide order dated 20.11.2019 passed in Criminal Misc. No. 73022 of 2019.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Nalanda, Biharsharif, in connection with Manpur P. S. Case No. 92 of 2019.
