2. The appellant is apprehending his arrest in connection with Bairgania P.S. Case No. 11 of 2018 in a case registered for the offence punishable under Sections 341, 323, 504/34 of the Indian Penal Code and Section 3(1)(x) of the SC/ST Act.

3. After some argument, learned counsel for the appellant seeks permission to withdraw this appeal.

4. Permission is granted.

5. Accordingly, this appeal is dismissed as withdrawn.

6. However, if the appellant surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the

Patna High Court CR. APP (SJ) No.1101 of 2021(4) dt.18-10-2023 2/2 learned court below on the same day without being prejudiced by this order.
