The petitioner seeks bail in connection with Katihar (Town) P.S. Case No. 490 of 2015 registered for the offences punishable under Sections 341, 324, 504, 307/34 of the Indian Penal Code.

Allegedly, the petitioner and other co-accused started abusing the informant, petitioner caught the informant from behind and co-accused Suraj stabbed the informant in his abdomen and thereafter, they fled away. Again Suraj and co-accused Kalicharan, Sumitra Devi caused threats and directed not to lodge the case.

Submission is of false implication and that the petitioner has not assaulted the informant rather only allegation is that he caught him from behind, he is suffering in custody since

Patna High Court Cr.Misc. No.6746 of 2016 (3) dt.08-04-2016 04.12.2015, chargesheet has already been submitted and there is no chance of tampering with the prosecution evidence. Learned APP fairly submits that Suraj has stabbed the informant and not the petitioner.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar (Town) P.S. Case No. 490 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
