Petitioners are apprehending their arrest in connection with Salkhua P.S.Case No. 212/2015 registered for the offences punishable under Sections 302, 120 (B) of the Indian Penal Code.
Case diary in the present case was called for, has since been received.
Learned counsel for the petitioners submits that there is no specific allegation against the petitioner No.2 Dilip Sah @ Dilip Kumar Sah though he has participated in the occurrence. It is further submitted that the allegation of firing is
Patna High Court Cr.Misc. No.7343 of 2016 (3) dt.21-04-2016 2/2 upon the person of the deceased is against Bindeshwari Sah and Phulendra Sah and not against these petitioners. Learned counsel on behalf of the State submits that after perusal of the case diary save and except there is no further material to implicate the petitioner in the present case. Considering the aforesaid facts and circumstances and that the petitioners are having no criminal antecedent, as is evident from para-3 of the application, let the above named petitioners, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri P.D. Mishra, A.C..J.M. II, Saharsa in connection with Salkhua P.S.Case No. 212/2015 (Anjana Mishra, J) Sudha/- U T
