JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 This is an application for grant of anticipatory bail in connection with Lakshmipur Girdhaur P.S. Case No. 447 of 2018, disclosing offences under Sections 147, 148, 149, 341, 448, 323, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against petitioner nos.1 & 2 is of assault by sword to one Manoj and allegation against petitioner no.3 is of assault by rod to one Mithilesh causing injury to him. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and the injuries are simple in nature. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui, in connection with Lakshmipur Girdhaur P.S. Case No. 447 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
