JUSTICE SHIVAJI PANDEY ORAL ORDER 20-05-2015 Heard learned counsel for the petitioners and learned counsel for the State as well as the informant. The petitioner seeks bail in Barh P.S. Case No.229 of 2014 instituted for the offences under Sections 302 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is also accused in four cases which have been mentioned in paragraph 3 of this application. As per the First information Report the informant has stated in specific terms that when she attended the court along with her husband the present petitioner and his co-associate also came to the court. There he hurled the threat to her husband about dire consequences in the event he goes and
Patna High Court Cr.Misc. No.2670 of 2015 (5) dt.20-05-2015 deposes against him in S.T. No.556 of 2013. Ultimately two days before the deposition of her husband he was killed by local goons.
Learned counsel for the petitioner submits that petitioner was in jail custody and the question of his direct involvement does not arise. So much so he is in jail since 13.7.2014. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to conclude the trial within a period of one year from the date of receipt/production of a copy of this order. (Shivaji Pandey, J) Vinay/- U T
