Petitioner seeks bail in connection with Rail Jhajha P.S. Case No. 83 of 2015 registered for the offences punishable under Sections 341, 323 and 377of the Indian Penal Code. Allegedly, the petitioner being a constable committed unnatural sex with the informant in the latrine of train. Submission is of false implication due to dirty politics, the victim has been examined by the doctor but no sign of unnatural sex was found, the petitioner is suffering in custody since 09.11.2015 and as such he deserves sympathetic consideration to which learned APP seriously opposes by submitting that the victim in his statement recorded under Section 164 Cr.P.C. has supported the allegation of unnatural sexual
