JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-04-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Kasim Bazar P.S. Case No. 188 of 2022, registered for offence punishable under sections 379 and 382 of the Indian Penal Code.

As per allegation, some unknown miscreants stolen away the ornaments from house of the informant. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent. He is innocent and his name has figured on the basis of confessional statement of co-accused Shiva Sahani. He has submitted further that the stolen ornaments were recovered from the shop of the petitioner.

No.3337 of 2023(2) dt.06-04-2023 2/3 He has also submitted that the petitioner runs a jewellery shop and he used to sell and purchase the ornaments and items of gold and silver. It was not within his knowledge that ornaments, which he was purchasing, were stolen property. The petitioner is in custody since 03.10.2022.

On the other hand, Mr. Shailendra Kumar, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances as well as clean antecedent and the period of custody, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 188 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner
