JUSTICE RAKESH KUMAR ORAL ORDER 08-04-2016 Heard Sri Rajesh Kumar, learned counsel for the petitioner and Sri Parmanand Prasad, learned A.P.P. The petitioner, who is in custody since 3.1.2016 in connection with Sarai P.S. Case No. 02 of 2016 registered for the offence punishable under Section 457, 380 / 34 of the Indian Penal Code has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner is not named in F.I.R. whereas F.I.R. was lodged against some of the accused persons. He submits that during investigation on the confession of one of the co-accused the petitioner has been implicated and recovery of one stolen battery and charger was shown. It has been argued that petitioner is having clean antecedent and this fact has been stated in paragraph

Keeping in view the nature of accusation and the period of custody, let the petitioner Bikku Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000 /- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - XIII, Vaishali at Hajipur in connection with Sarai P.S. Case No. 02 of 2016. (Rakesh Kumar, J) Praful/- U T
