JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363 and 366(A)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner kidnapped the daughter of the informant with the intention of marriage. Learned counsel for the petitioner submits that victim in her Statement under Section 164 of the Cr.P.C. has stated that she left the house on 25.04.2022 and married with the petitioner and no one kidnapped her. She wants to live with her husband. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks

Patna High Court CR. MISC. No.4129 of 2023(2) dt.09-05-2023 2/2 from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gopalganj in connection with Sidhwalia P.S. case no 180 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
