JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are in jail custody since 14.10.2014 in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
It would appear from perusal of the impugned order that except information of spy of the police, there is nothing against petitioner no. 1 and so far as petitioner no. 2 is concerned, one witness, Kundan Kumar, whose statement was recorded under Section 164 of the Cr.P.C, disclosed that he had purchased the mobile from petitioner no. 2. Except the aforesaid materials, there appear to be nothing against the petitioners.
