Petitioner is apprehending his arrest in connection with Fatehpur P.S.Case No.164 of 2019 , registered for offences punishable under Sections 341, 323 & 308/34 of the Indian Penal Code.
As per the prosecution case, petitioner and co-accused Jahangir assaulted the informant by Chapar. It is stated that the petitioner was also there. There is also allegation of snatching of golden chain and ring.
Submission of the learned counsel for the petitioner is that there was enmity between Jahangir Khan and the informant and as the petitioner happens to be friend of Jahangir Khan, he has been implicated in this case without
Patna High Court CR. MISC. No.2932 of 2020(2) dt.24-01-2020 2/2 having any specific allegation and also no criminal antecedent. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Fatehpur P.S.Case No164 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
