2. The petitioner apprehends his arrest in a case registered under Sections 379 and 411 of the Indian Penal Code.

3. It is alleged that petitioner is involved in stockpiling 7,400 cubic feet of illegal sand.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case on the basis of suspicion. Further submission is that nothing incriminating material has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.2346 of 2026(4) dt.19-03-2026 2/2 Petitioner has no concern with the seized sand, tractor or place of occurrence. Petitioner has got no criminal antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State and learned Spl. P.P. for the Mining Department opposed the prayer for bail.

Having considered the facts and circumstances of the case, submissions of learned counsel for the parties, nature of allegation against the petitioner and his clean antecedent, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Dehari Nagar P.S. Case No. 502 of 2020, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
