Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-06-2020 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is apprehending arrest in connection with Tankuppa P.S. Case No. 26 of 2019 for the offence under sections 420, 406, 409/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that the petitioner has already handed over the required folder for verification of the testimonials of Panchayat Shikshak and there is specific statement that petitioner was Panchayat Sachiv in Chowar Gram Panchayat and he has already handed over the concerned folder relating to Niyojit teachers and their merit list to his successor on 4.7.2019 who forwarded the same to the

Patna High Court CR. MISC. No.5013 of 2020(3) dt.19-06-2020 2/2 District Programme Officer, Gaya and District Education Officer, Gaya though the Block Education Officer, Tankuppa. Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Chief Judicial Magistrate, Gaya, in connection with Tankuppa P.S. Case No. 26 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. with further condition that one of the bailors should be government employee.
