The petitioner seeks bail in a case registered for the offence punishable under Sections 366(A)/34 of the Indian Penal Code.

Allegation against the petitioner in association of other accused persons is said to have kidnapped the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the victim is aged about 17 years and the statement of victim recorded under Section 164 Cr.P.C., she went alongwith the accused Deepak Kumar on her own sweet will and has married with him at Delhi. The said statement mentioned in para 24 supplementary case diary and in

Patna High Court CR. MISC. No.13377 of 2021(3) dt.27-09-2021 2/2 para 26 supplementary case diary the victim has not ready for medical examination. The petitioner is mother of accused, Deepak Kumar. The petitioner is languishing in judicial custody since 21.05.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition. The similarly situated co-accused have been granted bail by a co-ordinate Bench of this Court vide order dated 21.05.2021 passed in Cr. Misc. No.10717/2021.

Learned APP for the State vehemently opposed the prayer for bail application.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Masaurhi P.S. Case No. 197/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
