JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.

According to the prosecution case, it were co-accused Ram Kumar and Sanjay Kumar, who assaulted the deceased by means of iron rod and Khanti causing injury near his neck and cheek and after that, petitioner and co-accused Ram Kumar assaulted the deceased by means of iron rod.

The post mortem report of the deceased reveals that altogether four injuries were found on the person of the deceased. Out of aforesaid four injuries, one lacerated cut injury was found on the scalp whereas rest injuries were found on the mandibular area, jaw and neck of the deceased.

The contention on behalf of the petitioner is that the

No.7463 of 2016 (2) dt.17-02-2016 2/2 injuries, which were found on the mandibular area, jaw and neck of the deceased, are attributed to co-accused Ram Kumar and Sanjay Kumar and so far as injury found on the scalp of the deceased is concerned, it is not specific who caused the aforesaid injury, out of the petitioner as well as co-accused Ram Kumar. Considering the aforesaid injuries found on the person of the deceased as well as this aspect of the matter that the investigation has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Rosera in connection with Session Trial no. 691 of 2015 arising out of Bibhutipur P.S. No. 192 of 2015.
