The employee concerned retired way back in December, 1997 and the daughter-in-law filed the writ petition after more than 18 years in 2015 seeking refixation of pay under the 6th Pay Revision.
The learned Writ Court has dismissed the writ petition on account of the inordinate delay and the question as to whether simply because the petitioner is a nominee to receive
Patna High Court LPA No.538 of 2017 dt.12-03-2018 2/2 the post retiral benefits, she can claim revision of pay-scale. That apart, while the employee was alive and during his service period the employee never raised the ground seeking revision of pay-scale. Rejection of the writ petition on such ground, in our considered view, does not call for any reconsideration. The Letters Patent Appeal stands dismissed.
