2. The petitioner seeks bail in connection with Sonbarsa Raj P.S. Case No. 216 of 2023 registered for the offence under Sections 399, 402 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, the petitioner and others were caught planning a loot and there is recovery of one live cartridge from the petitioner and one country made pistol from the other co-accused.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saharsa in connection with Sonbarsa Raj P.S. Case No. 216 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Ghailarh Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Vikas/- U T
