JUSTICE PRABHAT KUMAR JHA ORAL ORDER 05-05-2015 Heard learned counsel for the parties, The petitioners seek their bail in a case registered under Section 307 and other sections of the IPC.
The petitioners are alleged to have assaulted the brother of the informant with iron rod on leg. Three injuries were found on fore-arms and leg. The injuries were opined by the doctor as simple. The petitioners are in jail since 16.10.2014. The petitioners have already remained in jail for more than six months. Learned counsel for the informant, however, vehemently opposes the prayer for bail and submits that the petitioners are accused in a murder case of uncle of the informant. Considering the facts that the petitioners have already remained in jail for more than six months, the petitioners, named above, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M, Bhagalpur in connection with Shahkund P.S.Case No. 114 of 2014, subject to the
Patna High Court Cr.Misc. No.3130 of 2015 (5) dt.05-05-2015 2/2 conditions that the petitioners shall appear in court on each and every date during the course of trial and if the petitioners failed to appear in court on two consecutive dates, without any reasonable ground, their bail bonds shall stand cancelled.
