Heard learned counsel for the petitioner and the learned APP for the State.

Learned counsel for the petitioner submits that due to inadvertence and reasons beyond his control, including intervening National Lock Down, till date, he has not been able to comply with the office note forming the basis of order dated 09.12.2019 passed in Cr Misc No 76099 of 2019. The said order was peremptory in nature and lapse has resulted in dismissal of the criminal miscellaneous application. He submits that he would be removing the defect (s) pointed out in the said

Patna High Court CR. MISC. No.6676 of 2020(2) dt.09-09-2020 2/2 criminal miscellaneous application, if he is allowed one week's time from today.

This application stands allowed in view of the aforesaid submission and Cr Misc No 76099 of 2019 stands restored to its original file and number.

Petitioner would be obliged to remove the defect (s), as per submission, recorded above.
