JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-04-2023 The present writ petition has been filed seeking the following relief:- "That this is an application for issuance of a Writ in the nature of Certiorari to quashing the Order dated 12/8/2016 passed in Case No. 01/D.M/2015 whereby and where under the representation filed by petitioners in the light of order dated 19/2/2015 passed in C.W.J.C No. 2197 of 2015 was rejected
Patna High Court CWJC No.5049 of 2017(2) dt.13-04-2023 2/2 by learned District Magistrate, Arwal, on the ground that- No document was produced by petitioners to substantiate their claims regarding the alleged land and for also issuance of a Writ in the nature of mandamus directing the respondent authorities to pay the adequate compensation to petitioners, who are the raiyat of the alleged land and/or pass appropriate order or orders as Hon'ble Court deem fit and proper."
At the outset, the learned counsel for the petitioners seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law, including that of filing a civil suit before the learned Civil Court of competent jurisdiction. Liberty, so sought, is granted.
The writ petition stands dismissed as not pressed.
