Patna High Court CWJC No.18000 of 2018(3) dt.14-12-2022 2/3 ORAL ORDER 14-12-2022 The Cabinet decision dated 07.06.2016 is assailed by filing this writ petition, more than 2 years thereafter on 06.09.2018, wherein the following prayers have been made: "(i) To issue an appropriate writ/order/direction, directing the Respondents not to give effect/implement the Cabinet Decision dated 07.06.2016 with regard to the petitioner (Accredited Statistical Volunteers) as far as abolishing their Panel is concerned and if the recommendation has been acted upon and a letter for abolishing the panel of the petitioner has been issued then to issue a writ of certiorari for quashing the said letter.

(ii) To issue an appropriate writ/order/direction in the nature of mandamus directing the respondents to allot the petitioner work related to date collection for which the purpose, the panel was prepared after advertisement and examination and to make payments of the work done by him.

(iii) To further issue an appropriate writ; order; direction, In the nature of mandamus commanding the Respondents to make payments of monthly fixed emoluments to the petitioner and to subsequently

Patna High Court CWJC No.18000 of 2018(3) dt.14-12-2022 3/3 regularize his service on monthly regular salary. (iv) Issuance of any other writ/writs, order/orders, direction/directions to grant relief/reliefs to which the petitioner is found entitled to in the facts and circumstances of this case."

2. The writ petition, apart from suffering with the vice of delay and laches is also suffering with deficiency in pleadings. Neither the date of petitioner's passing or competing the examination is given nor the appointment letter. Even the petitioner's order of posting has not been placed on record to substantiate that the petitioner was ever appointed as an Accredited Statistical Volunteer.

3. No case is made out for the reasons indicated above. Writ application is dismissed.
