JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-01-2020 The petitioner seeks regular bail in connection with Sadar (Hajipur) P.S. Case No. 449/2016, registered for offences punishable under Section 25(I-b)A, 26, 35 of the Arms Act. Police on information that some miscreants are planning to commit a crime, raided the place and arrested one persons, whereas another person succeeded in fleeing away and the apprehended accused disclosed the name of petitioner as his associate and further from the apprehended accused person, there was recovery of one country made loaded pistol. Apart from that petitioner is accused in one more case under Section 302 of the Indian Penal Code and Section 27 of the Arms Act. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the confession of co-accused and except that there is nothing against the

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur, in connection with Sadar (Hajipur) P.S. Case No. 449/2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
