The petitioner apprehends his arrest in Kadwa P.S. Case No. 264 of 2021, registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code.

As per the prosecution case, on the alleged date and time of occurrence, this petitioner along with three accused persons arrived at the place of occurrence took away machine tool BACKHOE LOADER (CAT) and also demanded cash of Rs. 13,50,000/-.

Counsel for petitioner submits that he has falsely been implicated in this case due to previous enmity. There is case and

Patna High Court CR. MISC. No.4650 of 2022(4) dt.21-11-2022 2/2 counter case. Petitioner is employee of the informant from June to September 2018 and when he demanded his due salary, this false case has been lodge by the informant.

Counsel for informant vehemently opposed the prayer for bail and submitted that there is specific allegation of extortion against petitioner and he has got six criminal antecedents.

Considering the facts aforesaid and criminal antecedents, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
