Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 498A/341/323/494/379/34 of the Indian Penal Code. This is a case under Section 498A of the Indian Penal Code arising out of a matrimonial dispute. Opposite Party No.2, who is wife of the petitioner, has already appeared. The parties have agreed for amicable settlement of the dispute before the Court-below or the Mediator appointed by the Court-below.

No.2191 of 2020(4) dt.05-10-2020 2/2 In the circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released provisionally on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Araria (Mahila) Police Station Case No. 98 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. The Court-below would confirm the provisional anticipatory bail if it would find the petitioner cooperative in the mediation proceeding to be completed within six months from the date of receipt of a copy of this order.
