The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 307, 435, 427, 384, 386 of IPC, 27 Arms Act, 3 & 4 Explosive Substance Act and 17 Criminal Law Amendment Act. Allegation against the petitioner and 50-60 persons is that they are members of MCC and they came to the informant's establishment and asked the informant and others to work in consultation with the petitioner, set fire and caused damage to the vehicle and office of the establishment.

Learned for the petitioner submits that there is no specific allegation of overtact against the petitioner. The petitioner has been in custody since 17.2.2014. Charge-sheet has

Learned counsel for the State submits that the petitioner has many criminal antecedents.

Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar/court concerned in Piprarhi P. S. Case No. 28 of 2011, corresponding to G. R. No. 140 of 2011 after framing of charge with following conditions:-

1. The petitioner will not indulge himself in similar or any other offence.

2. One of the bailors must be the close relative of the petitioner.

3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
