Petitioner seeks bail in a case for the offences punishable under Section 22 of the NDPS Act, 1985 and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Some cough syrup containing codeine as well as liquor was recovered from the vehicle of which the petitioner was owner-cum-driver. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 07.10.2019. Investigation of the case is already complete against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail, after framing of the charges against the petitioner so that trial may not hamper, on

Patna High Court CR. MISC. No.2010 of 2020(2) dt.21-01-2020 2/2 furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Trial No. 20 of 2019, subject to the following conditions:-

(1) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(2) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(3) The petitioner shall not leave the country without permission of the trial court.

The trial court is directed to expedite the framing of the charge against the petitioner.
